The 13th edition of the guide provides practical cross-border insight into construction and engineering law across multiple jurisdictions, bringing together contributions from legal practitioners around the world.
Construction & Engineering Law in Zimbabwe
CMCA’s Zimbabwe chapter provides an overview of the legal and regulatory framework governing construction and engineering projects in Zimbabwe.
The chapter addresses key issues encountered by developers, contractors, investors, financial institutions, consultants and other participants in the construction sector, including:
- construction contract structures and commonly used standard forms;
- FIDIC and local construction contracts;
- public procurement and public works;
- performance bonds, guarantees and retention arrangements;
- labour, tax, health and safety requirements;
- payment provisions and liquidated damages;
- variations and contractual risk allocation;
- delays, suspension and termination;
- force majeure and unforeseen circumstances;
- construction design and intellectual property;
- construction claims and limitation periods; and
- dispute resolution, arbitration and enforcement of awards.
The chapter also considers how Zimbabwe’s legal framework applies to both domestic construction projects and projects involving international investors, contractors and financiers.
About the Authors
Chipo Mafunga is the Founding Partner of ChimukaMafunga Commercial Attorneys and leads the firm’s Real Estate, Securitisation and Construction Law practice. Her work includes property and construction transactions, title investigations, securitisation, and the drafting and negotiation of construction contracts.
Dillon Chemhere is a Senior Associate at ChimukaMafunga Commercial Attorneys. His practice includes litigation and alternative dispute resolution, corporate due diligence, labour law, mining law and property law.
Together, their contribution provides a practical Zimbabwean perspective on the legal issues affecting the structuring, execution and resolution of construction and engineering projects.
